To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

You acknowledge that AI and machine learning technologies are inherently probabilistic and may produce unexpected or inaccurate results. You are solely responsible for validating and verifying all outputs from our Services.

To the maximum extent permitted by law, Hardmax LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to these Terms or our Services.

Our total cumulative liability arising out of or related to these Terms or our Services shall not exceed the amount paid by you to Hardmax LLC in the twelve (12) months preceding the event giving rise to liability.

These limitations apply regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless Hardmax LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your User Content or any data you provide to our Services
• Your violation of applicable laws or regulations

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.

8. Termination

Either party may terminate these Terms at any time with or without cause by providing written notice to the other party. We reserve the right to suspend or terminate your access to our Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Non-payment of fees (if applicable)
• Fraudulent, illegal, or abusive activity
• Request by law enforcement or government agencies

Upon termination:

• All licenses granted to you will immediately cease
• You must cease all use of our Services
• We may delete your account and User Content
• Sections that by their nature should survive termination will continue in effect

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, as well as applicable European Union regulations, directives, and laws, without regard to conflict of law provisions.

As Bulgaria is a member state of the European Union, EU law takes precedence where applicable, including but not limited to the General Data Protection Regulation (GDPR), the Digital Services Act (DSA), and other relevant EU legislation.

You agree to submit to the personal and exclusive jurisdiction of the courts located in Sofia, Bulgaria for the resolution of any disputes arising out of or related to these Terms or our Services.

12. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our Services, the parties agree to first attempt to resolve the dispute through good faith negotiations.

If the dispute cannot be resolved through negotiations within thirty (30) days, either party may pursue other available remedies, including arbitration or litigation, as determined by the governing law section above.
